Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and QuantegyAI ("QuantegyAI," "we," "us," or "our"). Read them carefully. By creating an account or using the Services, you accept these Terms. If you do not accept them, do not use the Services.

1. Eligibility and account

The Services are intended for users who are at least eighteen years of age, or who are signing up under institutional sponsorship for an educator-preparation or related programme. You must provide accurate registration information, keep it current, and maintain the confidentiality of your password. You are responsible for all activity that occurs under your account.

Teacher accounts are gated by single-use invite codes and are subject to additional terms applicable to teacher use of the Services, including the cohort-management features and student-data viewing privileges described in our Privacy Policy.

2. Description of the Services

QuantegyAI provides adaptive test-preparation tools for teacher certification examinations including TExES Mathematics 7-12 (test 235), TExES Mathematics 4-8 (test 115), TExES Core Subjects EC-6 (test 291), Praxis Mathematics: Content Knowledge (5165), and additional exams as listed on our website. The Services include a free diagnostic tier, one-time paid passes, and a Retaker Bundle, as described in Section 4. The Services include automated coaching tools, practice items, mastery estimates, and readiness assessments. The Services are not, and should not be used as, a substitute for any official preparation material published by the Texas Education Agency or its testing-services contractor.

3. No general guarantee of outcome

The Services are designed to support preparation for teacher-certification examinations. We do not generally guarantee that you will pass any examination, achieve any particular score, or be admitted to or successfully complete any educator-preparation programme. Examination outcomes depend on many factors outside our control, including your prior preparation, study time, examination-day performance, and decisions made by the Texas Education Agency or ETS. Any predicted-score, readiness-band, or pass-probability information shown within the Services is an estimate based on your interactions with the Services and the underlying psychometric model; it is not a prediction of your actual examination result.

Conditional pass-or-refund offer. The Retaker Bundle includes a limited, conditional money-back offer: if you complete the minimum verified practice threshold documented in the Refund Policy and do not pass the designated examination, we will refund the purchase price of that product. This offer is strictly conditional on meeting the documented requirements and constitutes a limited contractual commitment; it is not a warranty or guarantee of passing the examination. All other products are expressly excluded from this offer unless stated in writing at the time of purchase.

4. Products, pricing, and billing

QuantegyAI currently offers the following products. All prices are in United States dollars and are charged as a single one-time payment unless noted otherwise. No recurring subscriptions are currently offered. Charges are processed through Stripe, Inc.

Prices may change at any time for new purchases; the price displayed at the time of your purchase is the price you pay. No charge is incurred without your express consent. Because these are one-time purchases with immediate digital delivery, all sales are final except as described in our Refund Policy.

5. Acceptable use

You agree not to:

• Use the Services in any way that violates applicable law, including the Texas Penal Code, the Texas Education Code, or the Texas Educators' Code of Ethics.
• Misrepresent your identity, your eligibility, or your relationship to any institution.
• Share, resell, or transfer access to your account or any purchased pass.
• Attempt to extract, scrape, or copy in bulk the practice items, mastery estimates, or other proprietary content of the Services.
• Use the Services to develop a competing product.
• Probe, scan, or test the vulnerability of the Services without our prior written consent (responsible vulnerability disclosure as described in our security policy is permitted and encouraged).
• Disrupt, overload, or impair the Services or any underlying infrastructure.

6. Examination integrity

The TExES and Praxis examinations are administered under non-disclosure terms set by the Texas Education Agency, ETS, and their contractors. Any practice item or mastery scenario you encounter through the Services is authored or licensed by QuantegyAI; it is not, and is not represented to be, any item that has appeared on any official administration of any examination. You agree not to share, reproduce, or post live examination content within the Services or in any communication with QuantegyAI personnel.

7. Intellectual property

QuantegyAI and its licensors retain all right, title, and interest in and to the Services, the practice items, the engine, the dashboards, and all related materials, including all copyright, trademark, trade-secret, and other intellectual-property rights. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own examination preparation, subject to these Terms. "TExES" is a trademark of the Texas Education Agency; "Praxis" is a trademark of ETS. QuantegyAI is not affiliated with, endorsed by, or sponsored by the Texas Education Agency, ETS, or any of their contractors.

8. Privacy

Our handling of your information is described in the Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, in no event will QuantegyAI, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with the Services or these Terms, whether based on warranty, contract, tort, or any other legal theory, even if QuantegyAI has been advised of the possibility of such damages. Our total cumulative liability arising out of or in connection with the Services or these Terms will not exceed the greater of (a) the amounts paid by you to us in the twelve months preceding the event giving rise to the claim, or (b) one hundred United States dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless QuantegyAI, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination of a paid pass, access to gated content will cease at the end of the access period associated with your purchase. Sections 3, 6, 7, and 9 through 14 survive termination.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, with mandatory pre-suit informal resolution: the party raising a dispute must provide written notice describing it in reasonable detail, and both parties must attempt in good faith to resolve it within thirty days before initiating formal proceedings.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. If you continue to use the Services after the updated Terms are posted, you accept the revised Terms. If a change materially affects your rights, we will make reasonable efforts to notify you by email or by a notice within the Services before the change takes effect.
